In these Terms & Conditions references to āweā, āourā and āusā mean The Good Spirits Company (Scotland) Limited and “the website” or “our website” refers to www.thegoodspiritsco.com.
We reserve the right to change any of these Terms & Conditions at any time.

The first time you make a purchase we will check your details with third-party operators to ensure that you are over 18 and that your details or cards are not being used without your permission. We may require further identification from you.
Products:
We do not guarantee that a product will be exactly as described or illustrated. If your purchase depends on the particular vintage or batch of a product, please get in touch with us by email or phone to confirm before purchasing. Prices and specifications can change without notice and products are subject to availability. This does not affect your statutory rights as a consumer.
Payment:
You can pay for products using most major debit and credit cards.

Please note that we reserve the right to refuse the shipment of bottles directly to whisky auction houses.
Returns – Unwanted products:
If, for whatever reason you are unhappy with any products purchased which are not faulty, we will refund your money, or exchange the products if you inform us within 7 days after the day following the delivery of the products. Returns are at your risk and you must pay the delivery charge for return of unwanted products. All returned products must be returned to us in good condition, of which we shall be the sole judge. We will not accept returned products which are damaged. We will make reimbursements within 30 days of cancellation. Any product returned must be within its original packaging as sold.
Returns – Damaged products:
If any Products that we send to you are faulty or damaged we will either replace them or refund your purchase. If products are faulty or damaged, you must tell us within 48 hours of receipt of the products. All refunds or replacements will be made within 30 days of your notifying us of damage.
Tax:
All purchases for UK delivery or for collection in store are subject to UK VAT. Orders for delivery outwith the UK are not subject to UK VAT but may be liable for customs duties and local taxes in the destination country. All such duties and taxes are not included in the price we charge you.
User IDs and passwords:
You are responsible for your account and password when you register on our website. We will not be held responsible for any damages resulting in loss of password or unauthorised access to your account.
Cancellation and suspension of account:
We reserve the right to suspend or terminate your account on the website if you breach these Terms and Conditions.
Third party websites:
We are not responsible for the content of any third party websites that we might link to on our website.
Events outwith our control:
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by events outwith our control such as strikes, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war, fire, explosion, storm, natural disaster, or the failure of telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Limitation of Liability:
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Scots law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our website or any content on it, whether express or implied. We will not be liable to any user for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with (i) use of, or inability to use, our website; or (ii) use of or reliance on any content displayed on our website.
Please note that we only provide our website for domestic and private use. You agree not to use our website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Entire agreement:
These Terms and Conditions constitute all the terms and conditions agreed upon between you and us and supersede any prior whether written or oral. You acknowledge that you have not accepted the Terms and Conditions in reliance on any oral or written representations made by us that are not contained in the Terms and Conditions.
